Cookies and Similar Technologies Policy

This Cookies and Similar Technologies Policy explains how Kirill Anisimov, ABN 65 805 491 484, trading as MBS Fitness, of 115 Cove Hill Road, Bridgewater, Tasmania 7030, uses cookies and related technologies on www.mbsfit.net and connected digital services. In this Policy, “MBS Fitness”, “we”, “us” and “our” refer to that business.

This Policy should be read together with our Privacy Policy at https://www.mbsfit.net/privacy-policy and our Terms and Conditions at https://www.mbsfit.net/terms-and-conditions. The Privacy Policy explains more broadly how we collect, use, disclose, store and protect personal information and health information.

1. What Cookies and Similar Technologies Are

A cookie is a small text file stored on a computer, phone, tablet or other device when a person visits a website. Cookies can help a website operate securely, remember settings, maintain a login, process a booking or purchase, understand how the website is used, measure advertising and provide a more relevant experience.

We also use the term “similar technologies” to include pixels, tags, software development kits, local storage, device identifiers, session identifiers, conversion APIs and other technologies that can recognise a browser or device, record an action or transfer information between services. Some technologies, such as a server-side conversion API, may operate without placing a traditional cookie on the visitor’s device but can perform a related measurement or advertising function.

Some cookie information may not identify a visitor on its own. However, a cookie, online identifier, IP address, account identifier, device information or browsing activity may be personal information where it identifies a person or can reasonably be linked with other information to identify them.

2. Where This Policy Applies

This Policy primarily applies to the MBS Fitness website, including pages used for information, enquiries, free consultations, member accounts, class bookings, pricing plans, online purchases, forms, blog content and promotions.

The MBS Fitness mobile app may use local storage, device identifiers, app analytics, push-notification identifiers or third-party software development kits rather than ordinary browser cookies. Those technologies are covered by this Policy where they perform a similar function and are also addressed in our Privacy Policy and the privacy information presented through the relevant app store.

Third-party websites, apps and services reached through a link from MBS Fitness operate under their own privacy and cookie terms. This may include Apple, Google, Meta, PayPal or another payment, social-media or technology provider. We encourage visitors to review the relevant provider’s policies.

3. Why MBS Fitness Uses Cookies

MBS Fitness uses essential technologies to operate, protect and maintain the website, identify signed-in members, support accounts, process bookings and purchases, remember privacy choices, prevent fraud, balance traffic, detect errors and provide requested features.

With the visitor’s permission where required, we may also use functional, analytics and marketing technologies to remember optional preferences, understand website use, improve services, measure campaign performance, prevent repeated or irrelevant advertising and show advertising to people who may be interested in MBS Fitness services.

We do not sell personal information obtained through cookies. We do not knowingly use cookies to build advertising profiles about children. Marketing technologies are intended to reach adults, including adults researching services for themselves or their children.

4. Categories of Cookies We Use

Essential Cookies

Essential cookies are required for the website and requested services to operate securely. They support functions such as security, fraud prevention, network management, page rendering, member login, account sessions, bookings, checkout, payment processing and storage of privacy choices. These cookies are generally activated automatically because the website may not work correctly without them.

Blocking essential cookies through browser settings may prevent a visitor from signing in, making a booking, purchasing a plan, using checkout, saving privacy choices or accessing other core functions.

Functional Cookies

Functional cookies remember optional choices and help provide enhanced or personalised functions. Depending on the features currently enabled, they may remember display preferences, support chat or other interactive tools, or enable embedded content. Functional cookies are not required for the basic website to operate and will be controlled by the visitor’s cookie choice.

We aim to use analytics information in an aggregated or minimised form wherever reasonably possible. Non-essential analytics technologies will not activate until the visitor provides the relevant consent through the cookie banner.

Marketing Cookies and Pixels

Marketing cookies, pixels and similar technologies may be used to measure advertising, attribute a visit or conversion to an advertisement, manage campaign frequency, create audiences and deliver more relevant advertising. Depending on the integrations currently enabled, these services may include Meta Pixel, Meta Conversions API, Facebook or Instagram advertising, Google Ads or related Google advertising features.

Marketing technologies will remain disabled until the visitor consents to marketing cookies through the cookie banner. Refusing marketing cookies does not prevent a person from using the core website, booking a service or purchasing a plan, but advertising may be less relevant and campaign reporting may be incomplete.

5. Wix Platform Cookies

The MBS Fitness website is built and hosted using Wix. Wix places essential cookies for security, stability, rendering, fraud and attack detection, session management, API protection and core website functions. Wix business tools such as Bookings, Pricing Plans, Stores, Members, Forms and checkout may place additional cookies needed to provide the selected function.

The following table contains examples of essential cookies that Wix may place. Wix may add, remove, rename or update cookies as its platform changes, and the exact cookies present can depend on the features used during a visit.

6. Third-Party Services

Third parties may place cookies or receive online identifiers when their service is used or when the visitor consents to the relevant category. These providers act under their own privacy and cookie terms and may process information in Australia or overseas.

Wix supports website hosting, security, member accounts, forms, bookings, pricing plans, analytics, online purchases and related business functions. Google services may support analytics, search, advertising, maps, video or other embedded content where enabled. Meta services may support Facebook and Instagram advertising, social links, pixels and conversion measurement where enabled. Payment providers may use essential fraud-prevention and transaction technologies during checkout. Embedded video, map, social-media, chat or other third-party content may also use cookies when loaded or used.

A social-media link that simply directs a visitor away from our website is different from an embedded social widget. Once a visitor opens or interacts with a third-party service, that provider may collect information under its own policies, particularly if the visitor is signed in to an account with that provider.

7. Health-Related Pages and Sensitive Information

MBS Fitness provides fitness, health-related and disability-related services and may collect health information when a person completes a consultation, waiver, health screening, support or NDIS form. Browsing activity on health-related pages may also reveal or allow an inference about a person’s interests, circumstances or health.

We do not use advertising cookies, pixels or conversion tools to collect the contents of health forms, participant waivers, NDIS information, emergency details, payment-card fields or private messages. Non-essential marketing and analytics technologies must not be configured to transmit this information to advertising platforms.

Where a marketing or analytics event is used to measure a general action, such as visiting a public page or completing a booking, the information sent should be limited to what is reasonably necessary. We do not use a person’s disclosed health condition, disability, injury or NDIS status to target advertising without valid express consent and a lawful basis.

8. Cookie Consent and Your Choices

When the cookie banner is active, visitors can accept all cookies, reject non-essential cookies or manage individual categories. Essential cookies remain active because they are needed to operate and secure the website. Functional, analytics and marketing technologies are controlled according to the visitor’s choices and the technical capability of the website and integration.

A visitor can change or withdraw a cookie choice at any time through the Cookie Settings or Privacy Settings link made available on the website. Withdrawing consent does not affect processing that was lawful before withdrawal. Deleting cookies or using a different browser or device may remove the stored choice and cause the banner to appear again.

Visitors can also use browser controls to view, block or delete cookies. The method varies between browsers. Blocking all cookies may affect member login, bookings, checkout, saved preferences and other website functions. Private-browsing mode may reduce information stored on the device but does not automatically prevent every form of online tracking.

9. Consent Records

The website platform may record whether a visitor accepted or refused each cookie category. A consent record may include an online identifier, IP address, device information, consent selection, date and time. We use this record to respect the visitor’s choice, demonstrate that a choice was obtained and manage renewed consent when material cookie practices change.

Access to consent records is restricted to authorised people and service providers who need it for privacy, security, website administration or legal compliance. Consent records are retained only for as long as reasonably needed for those purposes and are protected in accordance with our Privacy Policy.

10. Cookie Duration

Some cookies last only for the browser session and are deleted when the browser is closed. Other cookies remain for a set period or until deleted. The duration depends on the cookie’s purpose, the visitor’s settings and the relevant provider.

Essential Wix cookies may last from a session to approximately 12 months, as indicated above. Analytics and marketing providers set their own cookie durations and may update them. The current cookie-settings tool and the provider’s policy should be consulted for the most current details.

We periodically review whether cookies and similar technologies remain reasonably necessary and seek to avoid retaining identifiable information longer than required for the stated purpose.

11. Overseas Processing

Wix, Google, Meta, payment providers and other technology services may process or store cookie information and online identifiers outside Australia, including in countries in which they or their service providers operate. The countries and safeguards can change as service infrastructure changes.

12. Do Not Track and Advertising Controls

Some browsers and devices provide “Do Not Track”, advertising-personalisation or privacy controls. Technical support for these controls varies between providers. The most reliable way to communicate choices on our website is through the cookie banner and Cookie Settings link, together with the controls available in the visitor’s browser, device, Google account, Facebook account or Instagram account.

Rejecting targeted advertising does not remove all advertising. It generally means advertising should not be selected using the rejected tracking activity. Clearing cookies may also clear a saved opt-out preference.

13. Children

MBS Fitness offers Kids and Youth programs, but the website, member account and purchasing functions are intended to be managed by a parent or legal guardian where the participant is under 18. We do not knowingly use cookies or similar technologies to create advertising profiles about children.

If we learn that a non-essential tracking technology has collected personal information directly from a child in circumstances where appropriate consent was not obtained, we will take reasonable steps to investigate, stop the relevant use and delete or de-identify the information where required.

14. Security and Data Minimisation

We take reasonable steps to select reputable technology providers, restrict access, configure consent controls, minimise the information collected and protect cookie-related personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

No website or transmission method is completely secure. Visitors should protect their account credentials, use supported browsers and devices, install security updates and notify us if they suspect unauthorised access to an MBS Fitness account.

15. Changes to This Policy

We may update this Policy when technologies, providers, website functions, privacy practices or legal requirements change. The current version and effective date will be published on this page.

If a material change affects how non-essential technologies use personal information, we will update the cookie banner or request renewed consent where reasonably necessary. A new non-essential integration should be correctly categorised and reviewed before it is activated.
